By Bert Randall, Esq.
Attorney Randall will discuss when disability is not a “disability” and the difference under Workers’ Compensation and ADA. He will review the duty to accommodate under the ADA and permanent restrictions and the effect on workers’ compensation when workers’ compensation and the ADA collide. Attorney Randall will explain common employer mistakes when dealing with permanent restrictions and how to combat permanent restrictions allegations. Attorney Randall will offer practical advice and a protocol for what to do when faced with permanent restriction in the workplace.
Albert (Bert) B. Randall Jr., Esq. is a principal in the Baltimore, Maryland office of Franklin & Prokopik. He concentrates his practice in the defense of employers primarily in labor and employment and workers’ compensation matters. Atty. Randall regularly represents employers in state and federal courts, and before state and federal administrative agencies, including: Maryland Workers’ Compensation Commission, EEOC and FEP agencies, DOL, MOSH/OSHA, and Office of Administrative Hearings. Attendees will learn about how to create a comprehensive drug-free workplace program, from policy development through implementation. Attorney Delogu will explain the benefits and limits of the available drug and alcohol testing choices, including pre and post accident testing, random testing, and probable cause testing. She will review the challenges of legal compliance for a multi-state employer, the role of the MRO, regulated and non-regulated test methodology, and the common mistakes employers make in administering their programs, and offer practical suggestions and best practices.
Nancy Delogu, Esq. is an expert on substance abuse in the workplace. An attorney in the Washington, DC office of the employment law firm Littler Mendelson, P.C. Attorney Delogu specializes in advising employers on developing, implementing, and administering substance abuse prevention programs that comply with the myriad of federal and state laws that affect such programs, including Department of Transportation (DOT) mandated programs. Attorney Delogu was Counsel to the Institute for a Drug-Free Workplace for many years, and before that, served as Associate Director of that non-profit advocacy group. She is also a co-author and former editor of the Guide to State and Federal Drug-Testing Laws. She is a frequent lecturer and author on substance-abuse issues, and other employment law topics such as workplace privacy and disability discrimination. Attorney Delogu graduated from Tufts University with honors and was awarded her Juris Doctor by the College of William and Mary in Williamsburg, Virginia. She is admitted to the bar in Massachusetts, the District of Columbia, and Virginia.

Work and Why: What Occupational Health Professionals Can Do About It

Recent studies have proven that certain risk factors are strongly associated with worse outcomes in work-related injuries. Techniques to identify those problems early on are now available. But what can we do about it? In this presentation, Dr. Pransky will review the latest research, offer practical suggestions and pathways for future development of more effective methods of early risk prediction and intervention to improve return to work outcomes.
Dr. Glenn Pransky is Director of the Center for
Disability Research at the Liberty Mutual Research Institute in
Hopkinton, MA. The Center is dedicated to scientific research on safe
and sustained return to work, has over a dozen active studies, and has
produced over 65 scientific publications in the past 8 years. He also
directs a large NIOSH - funded prospective cohort study of outcomes in
work-related injuries and illnesses in older workers, several other
studies of disability prevention and rehabilitation effectiveness in
work-related musculoskeletal disorders, and an investigation to measure
the work performance effects of work-related and other conditions that
do not result in full disability. He is the author of numerous
scientific articles on disability, measures of work-related outcomes in
occupational injuries and illnesses, treatment interventions, and
screening for occupational disease. He is board-certified in both
occupational medicine and internal medicine, and holds faculty
appointments as an Associate Professor in the Department of Family
Medicine and Community Health at the University of Massachusetts Medical
School, in Worcester, Mass, and at the Harvard School of Public Health
in Boston. Dr. Pransky received his M.D. from the Tufts University
School of Medicine, a master’s degree in occupational health from the
Harvard School of Public Health, and completed a research fellowship at
the Agency for Health Care Policy and Research.

Fred Ritsema, Esq. is a partner and trial attorney in the Denver, Colorado law firm of Ritsema & Lyon. He has been practicing in the area of workers’ compensation since 1976. Attorney Ritsema served for five years as the professional member on the Board of the Colorado Self-Insurer’s Association. He lectures widely in the field of workers’ compensation and bad faith actions and has served as an expert witness in these specialized areas. Workplace Violence: Designing a Prevention

She is a prolific author and speaker on preventing workplace violence; disability prevention and management; and on organizational health, safety, and wellness. Ms. Boucher is a certified occupational health nurse, Canadian registered safety professional, and internationally certified disability management professional. She has authored “Developing and Implementing a Workplace Violence Prevention Program” (4 texts).

native of the Buffalo, NY region, Dr. Siegel received his Bachelor’s
degree with High Distinction from Northwestern University, and his
Medical degree, Summa Cum Laude, from SUNY Buffalo. He completed
a fellowship in Sports Medicine at the renowned American Sports Medicine
Institute in Birmingham, AL, where he trained with Dr. Jim Andrews and
Dr. Bill Clancy. Dr. Siegel has treated professional, national, and
division I collegiate athletes, and has mastered the latest techniques
in arthroscopic surgical treatments of the knee, shoulder and elbow. Dr.
Siegel is a fellow of the American Board of Orthopaedic Surgeons, and a
member of the American Orthopedic Society for Sports Medicine (AOSSM),
the Arthroscopy Association of North America, and the Sports Medicine
Fellowship Society. He is also a founding member of Northeast Surgical
Care, an ambulatory surgery center in Newington, NH. His professional
interests revolve around the surgical and medical treatment of all
athletic injuries. Dr. Siegel has a particular interest in the treatment

FMLA: What
Occupational Health Professionals Need to Know

Attorney Fitzpatrick with discuss what information may be requested by the employer of the employee in the initial medical certification, and when the employer can require an employee to obtain recertification. He will discuss and answer questions about the FMLA, including: Can employees with less than 12 months service with the employer be nonetheless protected? What process must be followed to obtain an effective waiver of an employee’s FMLA claim? How do you calculate 12 months for the purposes of eligibility and measure 75 miles? When may an employee substitute paid leave for unpaid FMLA leave? What are the pitfalls for an employer who fails to properly notify an employee of his/her FMLA rights? And, when is an employee’s notice of the need for leave sufficient? Attorney Fitzpatrick will provide practical advice on dealing with FMLA and discuss what the status is of proposals to amend the FMLA.

He will explain which employers must keep illness and injury records, what records must be kept, and how long they must be kept by: exempt employers/industries, multiple business establishments, and record retention. Attorney Goodman will review: Per OSHA, under what circumstances must an illness or injury be recorded? Who are covered employees? What constitutes “work-relatedness” and what are the exceptions? When do injuries to traveling employees need to be recorded? What is a “new case” and what should be done when an injury or illness is not a new case? He will draw on his experiences to answer: May/must the employer honor employees’ requests not to include their names on the company’s illness and injury records? Are there situations where employee names must be kept off the illness and injury records? Who has the right to see the records of illnesses and injuries? When must the records be disclosed? What injuries or illnesses must be reported to OSHA? Are there downsides to over-reporting? Attorney Goodman will offer practical advice and suggestions on dealing with state variations and OSHA recordkeeping and reporting.

Pain: Work Disability Prevention

Dr. Sullivan will discuss pain and disability as a population health problem and the psychology of pain and disability. He will explain the psychological prognostic indicators of poor outcome and the role of catastrophic thinking, fear of pain, perceived victimization and perceived disability. Dr. Sullivan will review the roles that the patients and health care providers play in creating chronicity. Dr. Sullivan will offer practical suggestions for assessing psychosocial risk factors for prolonged pain and disability, intervention approaches for the management of psychosocial risk factors, and targeting psychosocial risk factors to improve return to work outcomes.
Michael John L. Sullivan, Ph.D. is Professor of Psychology, Medicine and Neuroscience and Canada Chair in Behavioral Health at McGill University. He received his B.A. from McGill University and his M.A. and Ph.D. from Concordia University. Dr. Sullivan has written and lectured worldwide on chronic pain, chronicity, and work disability prevention, as well as on other occupational issues. He conducts a clinical practice and extensive research on pain and disability. Dr. Sullivan is an associate editor of Pain and has been awarded Canada Research Chair in Behavioral Health for 2007-2014. His CD release with Stephen Read “Common Ground” was nominated “Best Country Artist” at the East Coast Music Awards.

Little Rock School of Law. As an attorney, Mr. Koonce practiced
primarily in the area of insurance defense and employment maters. He has
served as an Administrative Law Judge with the Arkansas Workers’
Compensation Commission. Mr. Koonce has also served as a Justice on the
Arkansas Court of Appeals. Mr. Koonce is a member of the Arkansas and
American Bar Associations, Board Member of the West Virginia Self
Insured Association, Board Member of the Northwest Arkansas Medical

Certification and Examination Update: The Latest Developments

is Vice President and an adult nurse practitioner at Mid State
Occupational Health Services, Inc. in Williamsport, Pennsylvania. She
received her BSN from Lycoming College and her MSN and adult nurse
practitioner certificate from Bloomsburg University. Ms. Olszewski is an
ANCC board certified adult nurse practitioner, and is a Certified
Occupational Health Nurse Specialist and Case Manager from the American
Board of Occupational Health Nurses. In 2007, she achieved her Fellow
distinction from the American Association of Occupational Health Nurses.
Ms. Olszewski performs over 1,000 DOT certification examinations per
year, and was selected as one of the only two adult nurse practitioners
nationwide to serve on the Federal Motor Carrier Safety Administration
Research Team, which is gathering data for the upcoming certification
requirements for medical examiners. Ms. Olszewski is President of the
Pennsylvania Association of Occupational Health Nurses and has recently
co-authored “Healthy People 2010 Occupational Safety & Health
Initiatives: A Systematic Approach for Occupational Health Nurses” in
the AAOHN Journal.

associate professor at Tulane Medical Center and the owner of Industrial
Safety and Rehabilitation Institute and ISR Physical Therapy. He
received his BS in physical therapy and his Ph.D. from Louisiana State
Medical Center. Dr. Bunch has written and lectured nationally and
internationally on functional capacity evaluations and health
productivity and wellness. Dr. Bunch is an ergonomic specialist and
industrial injury prevention consultant as well as a professional

Best Practices: Achieving Excellence in IME Management

Dr. Dorto will explain and show what to look for in a high quality, thorough independent medical examination (IME). Dr. Dorto will explain the entire IME process from the beginning of how to select an appropriate IME physician, what to look for in the IME report and how to act on the information contained in the IME report. Dr. Dorto will discuss the appropriate instruments that should be used for doing a high‑quality IME. The appropriate orthopedic, neurological and physical examination tests that are required for a good IME will also be discussed. The proper examination procedures for doing range of motion testing of the various body parts will be explained and presented. Dr. Dorto will thoroughly explain what should and should not be included in an IME report. He will also explain what issues may need to be addressed by the IME physician in order to address your needs. Dr. Dorto will explain when to request an IME, where to look for good doctors that have IME training, and how to determine what issues need to be addressed in the IME examination and what issues that may not need to be addressed in the IME examination/report.
Anthony J. Dorto, MD, is Board Certified in Physical Medicine & Rehabilitation (Physiatry), and is in private practice in Miami, Florida. A graduate of the State University of New York, Downstate Medical Center. He attended medical school at Centro de Estudios Universitarios Xochicalo (CEUX), Cuernavaca, Morelos, Mexico. He received his M.D. degree from the Board of Regents of the University of the State of New York (1984). He completed a surgical internship at Brookdale Hospital Medical Center, Brooklyn, New York. His three year residency in Physical Medicine & Rehabilitation was completed at Mount Sinai Hospital Medical Center, New York, New York. He graduated from Lincoln College, School of Chiropractic in 1969.
